By signing this Data Privacy Consent Form (“Consent”), I understand that I am agreeing to the processing, profiling and sharing of Personal Data in connection with my loan application with Active Alliance Finance Corporation (“Active Finance”), its subsidiaries and affiliates, or any other entity directly or indirectly owned or under the CL Follosco Group of companies in or outside the Philippines.
This Consent covers my Personal Data as well as Personal Data of family members, references, beneficiaries, authorized signatories or representatives, and other individuals (collectively, “Relevant Individuals”) whose information was provided by me, my authorized representatives or third parties, including Relevant Individuals and other available sources.
Personal Data may include, but is not limited to, names, identification particulars, contact details, patterns, history and behavior, employment information, financial background, educational background and demographic data. In particular:
- I agree that Personal Data submitted to Active Finance may be processed, profiled or shared to, by and between any of its affiliates and subsidiaries or Data Recipient (whether in or outside the Philippines). I acknowledge that such Personal Data may be processed or profiled by or shared with jurisdictions which do not have data protection or data privacy laws.
- I consent to the processing, profiling and sharing of Personal Data during the loan application and evaluation stages, as well as for the entire term of my loan with Active Finance up to a period of ten (10) years following the date of full payment. After the expiration of the ten (10) year period, Active Finance will destroy, purge, anonymize or render inaccessible or unusable the Personal Data. In case my loan application is rejected, I consent to the storage and processing of the Personal Data for a period of up to one (1) year/s from the rejection of said application, for evaluation purposes. Where Active Finance has deemed it necessary or required to fulfill foreign and domestic legal, regulatory, compliance and litigation requirements and disclosure to any court, authority or regulatory body or self-regulatory organization, I consent to the storage and processing of such Personal Data until the final conclusion of any requirement or disclosure obligation, dispute or action.
- Where I or my representatives have provided any Personal Data relating to any Relevant Individual to Active Finance, I confirm that each Relevant Individual has been informed and given consent to Active Finance’s processing, profiling and sharing of the Personal Data, and that I will obtain such consent in advance of providing any similar Personal Data in the future.
- These provisions shall be in addition to, and not in substitution for, any other loan application, or customer terms I have previously agreed to (whether before or after the date hereof) which gives broader rights to Active Finance than contained herein.
